Our Estate Planning Process

The estate planning process can be nerve racking.  Maybe you just don’t like the feeling of talking about your death. Who’s going to take care of your children?  What happens to all your stuff?  Who is going to take care of the house?  Maybe you don’t like the thought of talking about money.  At the Malolo Law Firm, we strive to make every part of our process as easy and painless as possible. Here’s a quick look at our process:

One Hour Consultation

We begin with a 1 hour consultation where we answer the who, what, and where questions. From there we will recommend the best plan for you.

Confirmation of Information

Within 2 business days of your initial meeting, we will send you the confirmation of information for you to check spellings and important parts.

The Signing Meeting

At your signing meeting, we’ll explain all documents in detail, execute your formal will ceremony, and sign & notarize all of your plan documents.

Final Binder Pickup

Once we finish signing, we will prepare your binder with all of your documents. As early as the next business day, your binder will be ready for pickup!

1 hour Consultation

Our estate planning process begins with a 1 hour consultation. In this consultation, we begin by asking the question, What happens to all your stuff if the unthinkable happens? We answer this question based on the laws of the state of Texas and discuss what happens upon death and what happens upon incapacity.

If you already have a will or trust, we will review your documents and explain the effect of your current plan.

When asked what will happen, most people respond with the wrong answer. Most people tell the story of what they would “like” to happen when they pass away or if they are incapacitated. We work with you in our consultation to discover your most important goals and find strategies to ensure that when you are gone, your plan is the best fit for your desires.

When we have fully discovered your wishes, we next recommend a plan that we believe will work for you. When we agree upon a plan, we will sign a client agreement and schedule a signing meeting.

Confirmation of Information

Within 2 business days of your initial meeting, we will send you the confirmation of information for you to check spellings of names, and to check the important parts of the plan such as executors and distributions to be made. These details are all ironed out before signing.

The signing meeting

At your signing meeting, we will explain all the documents in detail, execute your formal will ceremony, and sign and notarize all the necessary documents for your plan. We will collect any remaining fees due and ensure that you are satisfied with your service. We will also introduce you to the instructions and summary for you particular plan, ensuring you leave with confidence that your new plan will work for you.

Binder Pickup

Once we finish signing, we will scan your documents into our system and prepare your binder with all your documents. As early as the next business day, your binder will be ready for you to pickup.

How long does it take?

While we certainly believe that a job well done requires care and attention, it shouldn’t take forever! Depending on your availability for the consultation and signing, our process can be completed within 5 business days.
